By accessing or using PortfolIQ ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.

2. User Accounts

Billing

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable unless required by law
• We may change pricing with 30 days notice
• Payment failures may result in service suspension
• You may cancel your subscription at any time

4. Acceptable Use Policy

You agree NOT to:

• Use the Platform for illegal purposes
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or redistribute our data without permission
• Use automated tools to access the Platform (bots, scrapers)
• Reverse engineer or decompile any Platform components
• Share your account credentials with others

• Violate any applicable laws or regulations

5. Data Accuracy and Limitations

While we strive for accuracy:

• Data may contain errors or be delayed
• Third-party data providers may have outages
• Historical data may be incomplete or inaccurate
• We do not guarantee data accuracy, completeness, or timeliness
• You should verify critical information independently

You acknowledge that financial markets are volatile and that past performance does not guarantee future results.

The Platform and its original content (excluding user-generated content and third-party data) are the property of PortfolIQ and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Platform without explicit written permission.

7. Third-Party Services and Links

Our Platform integrates with third-party services and may contain links to external websites:

• We are not responsible for third-party content or services
• Third-party services have their own terms and privacy policies
• We do not endorse or guarantee third-party products

8. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTFOLIQ SHALL NOT BE LIABLE FOR:

• Investment losses or trading decisions based on Platform data
• Data errors, delays, or inaccuracies
• Service interruptions or downtime
• Unauthorized access to your account
• Third-party actions or services
• Any indirect, incidental, or consequential damages

Our total liability shall not exceed the amount you paid for the Platform in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless PortfolIQ, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or violation of any rights of another party.

10. Investment Risks Disclosure

You acknowledge and understand that:

• Cryptocurrency values are highly volatile
• You may lose all invested capital
• Past performance does not indicate future results
• Markets are subject to manipulation and fraud
• Regulatory changes can impact asset values
• You should only invest what you can afford to lose
• You should consult qualified financial advisors

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

Any disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.

12. Changes to Terms

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PortfolIQ regarding the use of the Platform, superseding any prior agreements.
